1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Marathon Variety Lda ("Company", "we", "us", or "our"), a company registered in Portugal, operating under the product name Gameframe.

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the modified Terms.

2. Service Description

Gameframe is a version control platform designed specifically for game development teams. Our services include:

• Version-controlled storage for game design documents, spreadsheets, and related content
• Branching and merging capabilities for document management
• AI-powered document analysis and entity extraction
• Team collaboration features including roles and permissions
• Integration with third-party services (Google Sheets, etc.)
• Activity tracking and audit trails

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to create an account. By registering, you represent that you meet this requirement and have the authority to enter into these Terms.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4. Subscription and Payments

4.1 Pricing and Plans

Gameframe offers various subscription plans. Current pricing is available on our website. We reserve the right to modify pricing with 30 days' notice.

4.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment processing is handled by Stripe
• All fees are non-refundable except as expressly stated or required by law

4.3 Free Trials

We may offer free trial periods. At the end of a trial, you will be required to select a paid plan to continue using the service. We will not charge you without your explicit consent.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.

5. User Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to content you upload to Gameframe ("User Content"). By uploading content, you grant us a limited license to:

• Store and display your content to you and authorized collaborators
• Process your content through our AI features
• Create backup copies for service reliability
• Perform technical operations necessary to provide the service

5.2 Content Restrictions

You represent that you have the right to upload all content and that your content does not:

• Infringe any third-party intellectual property rights
• Contain malware, viruses, or harmful code
• Violate any applicable laws or regulations
• Include content that is illegal, defamatory, or obscene

5.3 Our Intellectual Property

Gameframe, including its design, features, code, and documentation, is owned by Marathon Variety Lda and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our service without prior written consent.

6. Acceptable Use Policy

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or its infrastructure
• Transmit malware or engage in phishing or other malicious activities
• Use automated systems (bots, scrapers) without our permission
• Circumvent usage limits or access controls
• Share account credentials or allow unauthorized access
• Use the service to harass, abuse, or harm others
• Violate any applicable laws or third-party rights

Violation of this policy may result in immediate account suspension or termination.

7. Third-Party Integrations

Gameframe integrates with third-party services such as Google Sheets. When you use these integrations:

• You are also subject to the third party's terms of service
• You authorize us to access your data on those services as necessary
• We are not responsible for third-party service availability or data practices

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance (with advance notice when possible)
• Experience downtime due to technical issues or circumstances beyond our control
• Modify, suspend, or discontinue features with reasonable notice

We are not liable for any loss or damage resulting from service interruptions.

9. Termination

9.1 Termination by You

You may close your account at any time through your account settings or by contacting support. Upon termination, your data will be handled according to our Privacy Policy.

9.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms or our Acceptable Use Policy
• You fail to pay applicable fees
• Required by law or legal process
• Continued service poses a security risk

9.3 Effect of Termination

Upon termination, your right to access the service ceases immediately. You may request export of your data within 30 days of termination by contacting support.

• Your User Content
• Your violation of any third-party rights

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal, without regard to conflict of law principles. The courts of the Autonomous Region of Madeira, Portugal shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the service.

If you are a consumer in the European Union, you may also have rights under the laws of your country of residence, which cannot be waived by contract.

Before initiating formal legal proceedings, you agree to contact us at support@tinytaps.games to attempt to resolve any dispute informally. We will make reasonable efforts to address your concerns within 30 days.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the service.

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign our rights to an affiliate or in connection with a merger, acquisition, or sale of assets.
